Complainants would represent to the Court that Wilie Neal departed life in Giles County many years ago leaving surviving his widow Nancy and his children: William D., Charles J., Susan A. wife of Elisha Knight, Jamima wife of William O. Bradley, Elizabeth wife of William Kennedy, Martha A. wife of W.P. Scott, Wilie W., Sarah P. widow of John Black Jr., deceased, Cassie wife of Bluford Johnson, Amanda wife of W.K. McKnight, Goerge Neal and David C. Neal his twelve children. Wilie Neal at the time of his death was the owner of a large and valuable estate both real and personal. Wilie Neal's estate had long since been steeled, where 300 acres of land was laid off the Nancy (widow) as Dower. Nancy has since died and this Cause is to settle her estate. Elizabeth Neal Kennedy sold her interest in the land to John Black who then died about 1880. He left surviving his widow Mar. T. and his children: Ann wife of W.H. Baugh, James S. , M.J., C.C., W.D., Thomas H. Black, Martha wife of Perry Henderson, Sallie O., wife of N.S. Marks, and the following grandchildren: Bettie wife of John P. Ezell, Bettie was daughter of Mary Black who married Jack Campbell, descendants of son John who died before his father, left Lucy A. Black, Helen wife of Thomas Butler, Johnnie Black and Alberta who married John Moore. She died leaving Walter E. and L. Moore of Limestone County, Alabama. Lucy Black and Helen Butler lived in Giles Co. Johnnie Black lived in Missouri with her mother Sarah P. Neal Black. Susan Neal Knight testified that Willam D. Neal was her brother, had been dead 27 years. He left widow Narcissa Caroline and son W.S.N. (Noah) Neal of Marietta, Cobb Co. Georgia. Mrs Knight lived in Cobb County after death of John Black, Jr. His widow Sarah P. married M.D. McLean.

Mrs. Elizabeth Kennedy sues by her next friend W. C. Bradley. Mrs. Kennedy is trying to hold on to some of her property conveyed in a Deed of Trust by her husband William P. Kennedy. This property belonged to Mrs. Kennedy. Her husband went into the Confederate Army and stayed until the close of the War. Mrs. Kennedy had five children. Elizabeth was a Neal before marriage. David C. Neal testified he was Elizabeth's brother. He and his mother helped her family during War years. William P. Kennedy left his family in February 1867. William P. Kennedy conveyed property to Memucan Hunt Butler, Isaac J. Barbor, Thomas B. Harwell. Mrs. Kennedy stated the property conveyed belonged to her. Testimony by William C. Bradley, David C. Neal, W. K. McKnight, William B. Hardy, Robert Frazier, Fletcher Oliver, Elizabeth Kennedy, James M. Brownlow. William C. Bradley stated he was Mrs. Kennedy's brother-in-law.

Elizabeth Kennedy vs. William P. Kennedy
Elizabeth Kennedy stated she and William P. Kennedy were married in Giles County in 1846. She charged very cruel and inhuman treatment. He failed to provide for his family or give them any attention. He beat Complainant. His language was abusive. They ahd several children three of whom were girls. William P. Kennedy desserted his family and moved to Alabama and was living in adultery. Divorce was granted.
Henry ROBERSON/ROBERTSON [scrapbook] 1 was born 5 Nov 1818 in Giles Co, Tennessee. He died before 27 Jul 1858 in Union Co. AR. Henry married Elizabeth Ann Minerva JONES.
It has not been proven beyond a reasonable doubt that Henry is a brother to Sharp and William is his father, but everything points in that direction. This is just speculation at this time!
Birth dates were from 2 pages of the family Bible still on file with pension records. (I have these scanned and can send if anyone is interested.)

Elisabeth Ann Manervey was born 5/28/1826. (in AL)They were married at her father's in March of 1847, so the Jones family lived nearby, probably also in Union County. (I have found a Jones family on the 1850 census whose parents came from SC and some of the kids from AL with the younger ones from AR.)

Henry was buried locally on July 28, 1858 after dying on July 27.
Neither Henry nor Elizabeth had any other marriage.
She obtained a pension of $8/month at a cost of at least $20 in legal fees from July 27, 1892 through her last payment on Aug 4, 1899. Elizabeth died on Sep 6, 1899.
Henry enlisted May 20, 1838 and was discharged from service June 24, 1838. He was in service 35 days and 13 days travel. Served as a private in Captain Wallce's Company in 3 Battalion of the Tennessee Vol Infantry (Cherokee Division)
Henry was in A. Wallace's company. He enrolled at Fort Cass and was discharged at Ross Landing, TN. He was paid from 5/20/1838 - 6/24/1838 for 1 month and 18 days, including 13 days travel - 200 miles to place of rendezvous, and 260 miles from place of discharge home. The company was ordered into service by General Scott. He mustered into service on 5/23/1838 at Calhoun, TN. He lived for a while in Stewart County TN after leaving service and before moving to AR.
Henry served as Rober t son and recorded the first few items in his Bible as Robertson before reverting back to Roberson without the "t" because he believed that was the proper spelling.
The full warrant number is 52.757-160-55 telling us that it was warrant 52757, for 160 acres because of the 1855 act authorizing bounty warrants
for that group of veterans.Henry was the father of William James Roberson, my gggrandfather.

- EAM purchased Lot of Cattle - $70, Lot of Hogs - $125, Lot - Farming Tools - $14, 3 Bee Hives - $2.25, Grind Stone - $1.50, Lot of Tools - $6- On Dec 8, 1871 Court issues a summons to the Sheriff for EAM Robinson to appear before the Judge of the Probate Court on Dec 11, 1871 to account for settlement of the Estate of Henry Robinson
- Feb 27, 1869 Administrator's Bond filed with the court - it is signed by EAM Robinson, John W. Britt, & John Leamons for administration of the Estate of Henry Robinson.
- Langford, attorney, files petition with the court Feb 21, 1872 stating that there are no further debts or property remaining to Estate other than the land itself. It requests that EAM Robinson be released from paying rent by paying taxes on the land so she may maintain & educate minor children heirs of the estate.Note: (some things we know from the records & other research)
The exact date of Henry's death in July of 1858 is still unknown.
We did not find him listed in the cemetary directories for Union Co.
This whole legal process took at least 14 years (!!) to complete.
Henry would have been less than 40 at his death, and William James, his son, would have been about 11, and the girls younger, with Henri Ellen not born until after his death.
Elizabeth Ann Manerva Jones Roberson probably could not read/write.
She probably did not remarry as documents as late as 1894 still show her listed as EAM Roberson.
John Leamons is probably the same man who married Emmeline Duke after Alex Hardin died. This makes him the step father of Sarah Keturah Hardin who married William James Roberson.
There were other documents in the file that we did not copy - they appeared to have been receipts for purchase of items (debts?).
There were some receipts for varying amounts of tobacco & whiskey (medicinal, I'm sure!).
There were other "Robinsons" and "Jones" in the Court files from approximately the same time period. Relationship to them is unknown at this time since we didn't have time to explore the files in more depth to see if "our" line is mentioned.
Henry's land records show that he got his last 320 acres in Union County following his death in 1858... purchase was dated 7/1/1859.Affadavit Info (obtained from OK cousins; there may be an official document on file in Un Co or Fed gov records)
Draft was written 3/22/1894 by J.F. Goode for EAM Roberson, age 67 of Cornie township in Union County.
Description of Henry Roberson at time of enlistment: 18 years, 6 feet in height, fair complexion, dark eyes & hair, by occupation, farmer. Cannot state company, comander or comrades of soldier. Military land warrant is numbered 52757. Enclosed page from family Bible in husband's hand. Noted name spelling from Robertson to Roberson.
Note that 2 of EAMs daughter's married Goode brothers.
IGI shows William James as son of Henry Roberson + Minerva Jones
William James mother, who I had always heard referred to by our family as Minerva Jones, was on the marriage record as Elizabeth Ann, and on some of the other stuff we got at the court house as Elizabeth Ann Minerva or EAM. She never signed her name, only put "her mark" on documents.
The 1880 census shows her as A.E. Robinson and Henri Ellen, at 21, is still with her in Garner township. They are listed as being next to the family of C.F. Goode and Alice V. and their first child, Robert.
John H. Goode is still living at home with his parents at age 22 in the 1880 census.

I have included all of this Dempsey Kennedy information because John Kennedy was a bondsman for the marriage of Dempsey and Dempsey was a bondsman for land purchase in Smith Co. TN for John. I believe that this is MY John and Dempsey is possibly his brother.

* CAL’S COLUMN *We resume the publication of the old records and our comments thereon. The time is Monday, June 21, 1802. The next item in the old records is as follows: “Deed, 300 acres, James Montgomery to John Kennedy, proven by the oath of Dempsey Kennedy; one of the subscribing witness thereto.” We know nothing of either of these parties. We presume that the Kennedys were perhaps brothers, and members of the present Kennedy family of Smith and adjoining counties. Some members of the family have shortened the spelling to Canada, so were are informed.

Dempsey Kennedy of the County of Smith who stands indicted for Murder appeared in Court according to his recognizance dated 23 Dec. 1802, was charged and pleaded not guilty. (p25)

May Term 1803 - Jurors for the State charge that Dempsey Kennedy late of the County of Smith did on the 17 Nov. 1802, with force and arms, at the said County of Smith, upon one Griffin West, make an assault, and that he, Dempsey Kennedy, with a certain oak plank about five feet long, five inches broad and one inch thick, which he the said Dempsey Kennedy in both his hands, upon the said Griffin West, upon the left side of the head, above the left ear, did strike & hit and giving to said West one mortal bruise and West did linger from the 17th November 1802 until the 14th day of January 1803 when West died in the County of Smith ..-Plea not guilty -- Continued until this term when came a Jury: Isaac Roberts, Jonathan Magness, Jones Henning, Willie Barrow, Nicholas Boyce, Joseph Walker, William Gillispie, Benjamin J. Bradford, Gideon Pillow, Nicholas Coonrod, David Cloyd, & Samuel B. Harris.and say that Dempsey Kennedy is not guilty as charged in the Indictment and nothing further appearing or being alledged it is considered by the Court that the said Dempsey be acquitted and discharged of the murder aforesaid.(ppl07-109)

State of Tennessee to the Sheriff of Smith County: Whereas Daniel Bridgement was bound by recognizance for his personal appearance at the Superior Court on the 2nd Monday in November 1803 to give testimony on behalf of us against Dempsey Kennedy who stood indicted for murder and the said Daniel Bridgement having been called but came not, it was therefore considered by the Court that the recognizance was forfeited....command you to make known to said Daniel that he be before the Judges of our Court at next Court . . . And now at this Term came the Defendant and on his affidavit it is ordered that the forfeiture be set aside and further ordered he pay the costs. [ppl52-153]
